1. Who we are

These Terms govern your use of www.encorebiolabs.com (the "Site") and every purchase made through it. The Site is operated by Encore Bio Labs LLC, 704 Willow Glen, El Paso, TX 79922 ("we", "us"). Contact: support@encorebiolabs.com.

2. Research use only

All products sold on the Site are research materials supplied exclusively for in-vitro laboratory research and analytical purposes. They are not drugs, medical devices, food, dietary supplements, or cosmetics. They are not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition, and must not be administered to humans or animals by any route. Nothing on the Site is medical advice or an instruction for use in humans or animals.

3. Eligibility

You may purchase only if you (a) are at least 21 years of age; (b) are a qualified researcher, or act on behalf of a laboratory, academic institution, or business with facilities and training appropriate for handling research materials; and (c) can enter into a binding contract. We may request documentation of eligibility or institutional affiliation at any time, and may refuse, cancel, or refund any order if eligibility cannot be confirmed.

4. Buyer representations

By placing an order you represent that: (a) you will use the products solely for lawful in-vitro research; (b) you will not use, sell, or supply them for human or veterinary consumption or any unlawful purpose; (c) you will handle, store, and dispose of them in accordance with applicable law and good laboratory practice; (d) importing and possessing them is lawful where you are; and (e) the information you provide is accurate.

5. Orders and acceptance

A listing is an invitation to make an offer. An order is accepted only when we send a shipping confirmation. We may refuse or cancel any order, including where we believe the products are intended for human or animal use, where the order raises fraud concerns, or where shipment to the destination is not permitted. If we cancel after payment, we refund the full amount to the original payment method.

6. Prices and payment

Prices are shown in U.S. dollars. The amount charged is the total shown at checkout, which our server calculates from the current catalog. Payment is processed by our third-party payment provider; we do not store card numbers.

7. Shipping, returns, and refunds

Governed by our Shipping Policy and Refund & Returns Policy, which form part of these Terms.

8. Product information

Specifications, identifiers, and documentation are provided for scientific information only. We make no representation about the suitability of any product for a particular research application.

9. Disclaimer of warranties

To the extent permitted by law, products are provided "as is" and we disclaim all implied warranties, including fitness for a particular purpose. Nothing in these Terms limits rights you have under mandatory consumer law.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for it. We are not liable for loss or injury arising from misuse, including any use in or on humans or animals.

11. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or misuse of the products.

12. Privacy

Personal data is handled as described in our Privacy Notice.

13. Governing law

These Terms are governed by the laws of the State of Texas, USA, without prejudice to mandatory consumer-protection rules that apply to you.

14. Changes

We may update these Terms; the version in force when you place an order applies to that order.
